Steps in the Conveyancing Process
Due Diligence
This involves verifying the seller’s ownership, conducting searches to identify any encumbrances on the property (like unpaid debts or restrictions), and ensuring the property is free from legal claims.
Review of the offer letter
We help the seller or the buyer to review the offer letter before accepting the terms.
After the negotiations we then help prepare the sale agreement.
Sale Agreement
We engage our lawyer to draft the sale agreement outlining the purchase price, payment timelines and the completion conditions.
After review both parties can then sign the agreement.
Advisory on Statutory Taxes
We take the client through the statutory taxes i.e. – Stamp Duty.
The buyer pays the stamp duty to the KRA (Usually 4% of the property value for urban areas or 2% for rural areas).
Preparation of Transfer Documents
- Transfer documents are prepared and signed.
- These documents are then lodged at the Ministry of Lands for registration.
Post Registration Due Diligence
We follow-up with the necessary parties to ensure that the transfer has been done and that everything is in order with the title deed and registration.
